Clear terms for using Xiara.
These Terms of Use govern your use of Xiara, a conversational companion operated by Rocketch. By creating an account or using Xiara, you agree to these terms.

1. The service
Xiara is a conversational software service designed around continuity, intentional memory, and music as context. Features, model providers, limits, interfaces, and supported integrations may change as the product evolves.
Xiara is not a medical provider, therapist, emergency service, financial adviser, legal adviser, or substitute for qualified professional care.
2. Your account
You are responsible for maintaining access to your account and for activity that occurs through it. Provide accurate information when the service requires it and do not share access in a way that creates security or abuse risks.
You must be legally permitted to use the service where you live.
3. Your conversations and content
You keep your rights in the content you provide to Xiara. You give Rocketch the limited permission needed to process that content to operate the service, generate responses, preserve the continuity you request, provide support, protect the product, and comply with law.
Do not submit content you do not have the right to use or content whose processing would violate applicable law.
4. AI responses have limits
AI systems can misunderstand context, produce inaccurate information, or respond inconsistently. Xiara is designed to improve continuity, not to guarantee perfect memory, perfect judgment, or factual accuracy in every reply.
You remain responsible for important decisions and for verifying information when accuracy matters.
5. Intentional memory
Xiara separates conversation history from long-term memory. Long-term memory is intended to be created when you ask Xiara to remember something or confirm a suggestion.
Memory controls are part of the product, but no software system is infallible. Review or remove saved context when it no longer represents what you want Xiara to use.
6. Music and third-party destinations
Xiara may recommend music and provide links to third-party services such as Spotify, Apple Music, YouTube Music, Bandcamp, or Tidal. Xiara does not promise that a particular track, catalog item, or external link will always remain available.
Your use of third-party music services is governed by their own terms, privacy policies, subscriptions, and regional availability.
7. Acceptable use
Do not use Xiara to break the law, infringe the rights of others, interfere with the service, bypass access or usage controls, probe or exploit security weaknesses, automate abusive traffic, distribute malware, or attempt to obtain data that does not belong to you.
Rocketch may take reasonable steps to protect the service and other users when misuse creates a security, legal, operational, or abuse risk.
8. Free and paid plans
Xiara may offer free and paid plans with different usage and memory limits. Current plan details are shown on the Pricing page. Rocketch may change future pricing, limits, or included features, with appropriate notice when a change affects an active paid subscription.
Payments for Xiara Plus are processed by Stripe. You can cancel a paid subscription at any time through the available billing controls. Cancellation stops future renewals; paid access normally remains available through the end of the billing period you already paid for.
9. Billing, taxes, and failed payments
By starting a paid subscription, you authorize the applicable recurring charge until you cancel. Stripe may collect and process payment information under its own terms and privacy practices.
Applicable taxes may be added when required. If a payment fails, paid features may be limited or suspended until billing is resolved.
10. Cancellation and account changes
Cancelling Plus does not automatically erase your account, conversation history, or saved memories. Unless the product states otherwise, your account can continue under the plan available after the paid period ends.
You can separately use Xiara's memory controls or available account-deletion process when you want saved information removed.
11. Intellectual property
Xiara, its software, design, branding, and related product materials are owned by Rocketch or its licensors, except for content and rights belonging to users or third parties.
These Terms do not give you ownership of Xiara's software or permission to copy, resell, reverse engineer, or commercially exploit protected parts of the service except where applicable law expressly permits it.
12. Availability and changes
We aim to keep Xiara available and useful, but we do not guarantee uninterrupted operation. Features may be modified, paused, replaced, or discontinued for product, security, legal, provider, or operational reasons.
We may also update model providers or technical infrastructure without treating the underlying model as the relationship itself.
13. Suspension or termination
Rocketch may suspend or terminate access when reasonably necessary for serious abuse, security risk, nonpayment, legal compliance, or a material violation of these Terms. Where practical, we will try to provide appropriate notice.
14. Disclaimers and liability
To the extent permitted by law, Xiara is provided on an 'as available' basis without guarantees that every response, recommendation, memory retrieval, external link, or feature will be accurate, complete, available, or suitable for a particular purpose.
To the extent permitted by law, Rocketch is not liable for indirect, incidental, special, consequential, or punitive losses arising from use of the service. Nothing in these Terms limits rights or liabilities that cannot legally be limited.
15. Changes, applicable law, and contact
We may update these Terms as Xiara changes. The updated date will appear on this page, and material changes may receive additional notice when appropriate.
These Terms operate subject to applicable law and any mandatory consumer rights that apply to you. Questions about these Terms can be directed to Rocketch through the contact information published on www.xiara.co.
